Called to Order at 7:30 PM under M.G.L. Chapter 131, s.40 and the Hanson By-Law 1-13, s.5. by Philip Lindquist, Chairman, in Meeting Room A at the Town Hall.

Public Hearings

7:45 PM  Request for Determination of Applicability for the installation of a deck within 100 feet of a Bordering Vegetated Wetland at 202 Maquan Street, Map 71, Lot 20B for J & M Curran represented by Allan Clemons

Sean Chrisman read the Public Hearing Notice and the abutters list was verified.  Allan Clemons presented a revised plan.  The proposal calls for a deck with concrete piers.  All digging will be done by hand.   Ms. Delaney commented that the edge of pond is considered the resource area for the purposes of this filing.  She recommended that the 50-foot setback is maintained as there is room to make a modification to the plan.

8:00 PM Continued Notice of Intent  for the construction of a garage at 76 Woodbrook Lane, Map 116, Lot 5-6A, Hanson, MA for Shaun MacPherson, owner   (DEP #SE175-___)

Shaun MacPherson presented a revised plan.  The wetland line had been re-flagged per request of the Commission and had changed significantly.  The location of the garage had been moved to maintain a 50-foot buffer and mitigation in the form of a row of arborvitae were shown on the plan.  Ms. Delaney commented that this was a Riverfront Project and an Alternative Analysis (that determines that no other feasible alternative exists that is economically viable) was not submitted as required by the Rivers Protection Act 10:58 (4) (c) 1. Lack of an Alternative Analysis is acceptable provided that the Commission reviews it as a Redevelopment Project under Redevelopment Standards CMR 10.58 (5).  As presented, the project does not meet the criteria for a Redevelopment Project.  The Commission suggested that Mr. MacPherson revise and submit the plan to DEP and ask for comments from DEP.  There was some discussion regarding the original location proposed at the end of the driveway, however the 50-foot No Disturb Zone wouldn’t be met.  Also, they would need more time to review a plan to make a determination.

Motion to continue to October 11th at 8:00 PM pending review of a revised plan and Mr. MacPherson submitting a copy of the plan to DEP:  Ron Grattan

8:15 PM Continued Request for Determination of Applicability for the repair of a septic system at 304 King Street, Assessor’s Map 115, Lot 2-2 for Stephen & Marcia Savoy represented by James Engineering, 125 Great Rock Road, Hanover, MA   

Mr. Gary James of James Engineering presented a revised plan for a septic repair.  A portion of the tank is within the 100-foot buffer zone.

8:45 PM Continued Notice of Intent for a proposal for a four (4) lot residential subdivision with 640 linear feet of roadway.  Total area = 18.98 acres at 1460 Main Street, Assessor’s Map 44, Lots 5F & 7C for Jack Van Aiken, Great Cedar Condominiums, LLC, 31 Schooset Street represented by Land Planning, Inc., 1115 Main St., Hanson, MA.  (DEP #SE175-0478)

Bob Crowell and Bernie Munro of Land Planning made a presentation after the abutters list had been verified.  The proposal calls for a roadway with drainage structures and associated grading.  All construction is out of the 50-foot buffer zone.  Haybales are proposed.   This is a condominium project for which individual filings will be made in the future.  The Post

Construction Operation and Maintenance plan indicated that a Condo Association shall be formed.  The Highway Department had approved it .    No abutters were present.

Appointments

8:30 PM  Informal Meeting with Roy Vinton & Steve Giosa regarding Lot 4A on Valley Forge Road  
Mr. Vinton and Mr. Giosa of SITEC showed the Commission a plan for a lot that has an isolated wetland situated on it.  They wanted the Commission to give them a feeling for whether the wetland could be partially filled and replicated so that a setback could be maintained for a house.  It was Ms. Delaney’s reaction that the only grounds for wetland filling would be to gain access to an upland, not to create a house lot.  The discussion was continued for consideration until October 11th at 8:30 PM.   

9:00 PM  Appointment with Geoff Angell regarding installation of a shed at 10 Fallon Point Road within 50 feet of a resource area.
Mr. Angell and his fiancée, Michelle attended the meeting with a building permit application for a shed that would be within 50-feet of a resource area.  Their entire property is surrounded by wetlands consisting of a ditch, a bog and a pond.  They have no other alternative and their house was built before the current by-law was in effect.  The shed would be constructed on cinderblocks.  After some discussion, the Commission voted to approve the shed and allow Ms. Delaney to sign off on building permits for sheds on a case by case basis using her own discretion.

9:15 PM  Appointment with John Barrows of Marchionda & Assoc., L.P. re:  modifications to the Stonebridge Commons Site plans
Mr. Barrows  representing Pulte Homes of New England, new owners of the Stonebridge Commons property, attended the meeting to explain to the Commission that he had met with and consulted with Mark Ridder, former owner on the project.    He assured the Commission

that Pulte Homes would follow the same footprint and it was the same project that was previously approved.   In her review of the file, Ms. Delaney had noticed that the Extension Permit for the superseding Order of Conditions had not extended the By-Law permission for the crossing.

Discussions

Request to review modifications to the plan at 255 Rear Liberty (DEP #SE175-0433) for Dennis Leary, Trustee of Hudson Park Associates

        Motion to require Mr. Leary to file for an amended Order of Conditions:  David Harris

341 Maquan St. – Ms. Delaney wanted to bring attention to the Commission that Mr. Alexander MacDonald of 341 Maquan St. was building a retaining wall across from the pond.  Mr. Alexander, who attended the meeting, informed the Commission that he had put in haybales.  The Commission agreed that Mr. MacDonald could continue what he was doing.
999 Main Street  - The Commission was satisfied with the plan that was submitted
559 Liberty Street –  DEP had inspected and will issue an Enforcement Order to the Huntley’s
Off Woodbine, Map 7, Lot 47 – Ms. Delaney had inspected, boat was removed from easement, one tree slated for cutting was located within the jurisdiction of the Commission.  
50-foot No Disturb Policy -  Blanket Permit for minor projects 50 feet or more from wetlands – Ms. Delaney will work on this and have something ready for discussion and approval at the next meeting.
